Bold claim: this is a case that exposes how quickly a seemingly ordinary situation can descend into a serious drug scandal. And this is the part most people miss: what starts with a suspicious moment can reveal deeper struggles, choices, and consequences that ripple beyond a single judgment.
A 23-year-old apprentice electrician from Clonown, Athlone, Co. Westmeath, admitted to possessing drugs and possessing them for sale or supply after an incident in Athlone on February 10, 2023. The court heard the sequence of events as police records unfolded.
Detective Garda John Divilly testified at Mullingar Circuit Criminal Court that his attention was drawn when another man was seen urinating beside Kelly’s car. This observation led the Gardaí to pull into the car park, from which three men stepped out of Kelly’s vehicle.
Kelly himself emerged from the driver’s seat and dropped a package wrapped in cling film. The item was retrieved and identified as a single deal of cocaine. A search of his car then uncovered a bar of uncut cocaine, which fortified the case against him. At the time, Kelly, described as a 20-year-old machine operator, denied any knowledge of the drugs and refused to provide his phone’s PIN when asked.
During the investigation, Kelly did not offer material assistance to the Gardaí. Later, however, he told his probation officer that he had been holding the package for the person who supplied him, claiming the cocaine represented debt he had accrued.
The Gardaí concurred with defence counsel John Shortt’s assessment that Kelly came from a supportive, respectable family and was deeply ashamed of his actions. Kelly, who had no prior convictions, explained that he had started using cocaine after beginning to go out socially and that he owed money for drugs.
He also disclosed ongoing attendance at drug counseling and expressed remorse, noting his family’s strong support. He stated he would provide urine samples through his doctor for testing.
When asked why he had said nothing to the Gardaí, Kelly replied that fear and threats from his supplier were the underlying reasons. He later clarified that those fears were specifically tied to his supplier.
The judge, Judge Kenneth Connolly, acknowledged troubling aspects of the case and questioned why the cocaine was in Kelly’s car in the first place. He noted that the substance involved is a Class-A drug and reflected on a perception that such drugs have become perceived as more normalized and easily obtainable.
Despite presenting as an otherwise law-abiding, employed, and intelligent individual, the court heard evidence suggesting Kelly had been involved in a subsequent car pursuit with Gardaí in January, a claim that culminated in him abandoning the vehicle despite holding valid driving documents.
Remanding Kelly in custody, Judge Connolly stated that he needed time to calm down and assess the full context of the matter. The sentencing hearing was scheduled for December 12, with a request for a GP’s report to be provided ahead of that date.
